Welcome to Apparel Division by FSC ("Apparel Division", "we", "our", or "us"). By accessing or using our website, you agree to these Terms of Service. If you do not agree, please do not use our website.

These Terms govern your use of our website and the purchase of products from Apparel Division by FSC.

We reserve the right to update these Terms at any time. Changes become effective when published on this website.

By placing an order you confirm that:

  • You are authorised to use the payment method supplied.

We make every effort to accurately display our products.

Please note:

  • Colours may vary between devices.
  • Product measurements are approximate.
  • Minor variations in print placement, garment sizing and colour may occur during production.

These variations do not constitute manufacturing defects.

4. Pricing

All prices are displayed in Australian Dollars (AUD).

Prices include GST where applicable unless otherwise stated.

We reserve the right to change pricing without notice.

5. Orders

All orders are subject to acceptance.

We reserve the right to:

  • Decline an order
  • Cancel an order
  • Limit purchase quantities
  • Refuse orders suspected of fraud or misuse

If payment has already been processed for a cancelled order, a full refund will be issued.

6. Payment

Payment must be received before an order is processed.

We accept approved payment methods displayed during checkout.

7. Shipping

Estimated delivery times are provided as a guide only.

We are not responsible for delays caused by:

  • Shipping carriers
  • Customs
  • Weather events
  • Industrial action
  • Circumstances beyond our reasonable control

Ownership and risk pass to you upon delivery.

8. Returns & Refunds

Returns and refunds are governed by our Returns & Refund Policy.

Nothing in these Terms limits your rights under the Australian Consumer Law.

9. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

10. Black Pass Member Pricing

Black Pass member pricing is available only to eligible active members.

Member pricing:

  • Cannot be transferred.
  • Cannot be combined with other offers unless stated.
  • May be modified or withdrawn in accordance with Black Pass membership terms.

11. Intellectual Property

All website content including:

  • Logos
  • Graphics
  • Designs
  • Images
  • Product names
  • Text
  • Branding

is owned by Apparel Division by FSC or used under licence.

No content may be copied, reproduced or used without written permission.

12. Limitation of Liability

To the maximum extent permitted by law, Apparel Division by FSC is not liable for:

  • Indirect loss
  • Consequential loss
  • Loss of profits
  • Business interruption
  • Loss arising from misuse of products

Nothing in these Terms excludes rights that cannot legally be excluded under Australian law.

13. Privacy

Your use of this website is also governed by our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Any disputes will be subject to the jurisdiction of the courts of New South Wales.
